Terms and conditions

1 – PREAMBLE

The customer declares that he/she has full legal capacity to enter into commitments under these General Terms and Conditions of Sale, i.e. that he/she is at least 18 years old and not under guardianship or curatorship. The customer declares that he/she is reserving services on a personal and private basis, to the exclusion of professional resellers. 2 – CUSTOMER DEFINITION

The customer is a person entering the site or receiving an entry to the Loft Saint-Marc.

3 – CONTENTS

These terms and conditions apply to all services and sales of products offered on the website. They are automatically made available to the Customer on the home page of the website.

Placing an order implies the Customer’s full and unreserved acceptance of these General Terms and Conditions of Sale.

These General Terms and Conditions of Sale may be modified at any time, without prior notice. These modifications will not apply to bookings made previously. Only the General Terms and Conditions of Sale in force at the time of booking are binding on the customer.

The customer acknowledges having read and accepted these General Terms and Conditions of Sale.

The Loft Saint-Marc website and services are intended for adult customers only. Any access or use of the site or services by a person under the age of 18 is strictly forbidden. By accessing or using the site or services, customers declare that they are at least 18 years old.

4 – SETTLEMENT AND PAYMENT

The customer guarantees that he/she is fully authorised to use the means of payment provided for the payment of his/her order and that this gives access to sufficient funds to cover all costs resulting from the purchase of his/her service.
The promotional offers proposed by the Loft Saint-Marc are not cumulative. Gift vouchers and special offers are strictly reserved for a particular clientele.
Except in the case of special promotional offers, the applicable rates are those shown on the Loft Saint-Marc website, in force at the time of booking. The published public rates are subject to change without notice.
The prices shown are in euros, inclusive of all taxes, and are valid only for the dates indicated on the booking confirmation; they include tourist tax.

The customer will receive a booking confirmation following his/her order. Confirmation of the customer’s booking by Loft Saint-Marc is subject to receipt of the price of the services and a copy of the customer’s identity document, which will be requested after payment.
Confirmation of the booking summarises the services ordered and the corresponding prices.

Payment is made by credit card (Carte Bleue, Visa, Master Card/ Eurocard), the holder of which is the reserving party.

Payment for the stay must be made in full by credit card on the Loft Saint-Marc website.

5 – EARLY DEPARTURE AND NO-SHOW

In the event of early departure, no refund. In the event of no-show (cancellation without notice), no refund.

6 – HANDING OVER OF KEYS / ENTERING THE PREMISES

Entry to and departure from the property are carried out in person with our concierge between 4pm and 10pm. The customer will enter the code on the digicode at the entrance door to gain access to the loft for the duration of the stay.

The customer must register on the PassPass mobile application to access the welcome booklet with the traveller’s guide to facilitate occupation of the premises and use of the accessories provided.

When customers leave the premises, all they have to do is slam the door shut and enter the end code to lock the door. They should also check that the lights are switched off and that the windows are closed.

7 – ARRIVALS AND DEPARTURES

Check-in is possible from 5 p.m. and check-out is at 11 a.m. maximum, except for premium members of the Loft Saint- Marc (late check-out at 12 p.m.). Upon arrival, customers may contact us by telephone or email to ask for details of the state of the property and may note the state of the property on the PassPass application.

Cleaning is included in the rental price. However, in the event of proven abuse, a supplement for damage may be deducted from the deposit.

8 – RENTAL SERVICES

The basic package includes :
The provision of the flat with its facilities (two suites with en-suite shower rooms and king-size beds, a private spa for two with shower), a fully-equipped kitchen (with microwave oven, toaster, kettle, dishwasher, fridge, induction hob, plancha, Nespresso machine with capsules, crockery, etc.), a lounge (with corner sofa, TV, home cinema, indoor swimming pool and fireplace), the provision of household linen and bathrobes, a fast Wi-Fi connection and a cleaning service on departure.

9 – OCCUPANCY RULES

Loft Saint-Marc has its own internal regulations which can be consulted on site. The Client undertakes to read them at the beginning of their stay and to respect them.

Loft Saint-Marc has a maximum capacity of 4 adults, which the Customer must respect. Any breach of this rule will result in the immediate eviction of all occupants without notice. A security camera monitors people entering the accommodation. The Customer must return the flat, including all its furniture and accessories, in the condition in which they found them on arrival.

The Customer acknowledges that he/she is responsible, not only for his/her own acts or omissions, but also for those of any other occupants.

The customer undertakes to leave the premises at the end of the chosen service and by 11.00 am the following day at the latest.

In the event of failure to do so, Loft Saint-Marc reserves the right to invoice the client for any overtime occupancy of the premises, at the usual rate, plus a penalty equal to twice the cost of an overnight stay, as compensation for the inconvenience suffered, which the client undertakes to pay.

The Customer will be liable to Loft Saint-Marc for all acts or costs incurred in the recovery of outstanding payments or in connection with the Customer’s eviction.

Minors under the age of 18 are not permitted in the flat without their parents.

Pets are not allowed.

Smoking and vaping are strictly prohibited in the flat. A courtyard is available to guests on the ground floor.

In addition, the flat may only be used for residential purposes by the tenant, who must enjoy the property peacefully and reasonably within the meaning of the French Civil Code. The tenant must comply with the building’s co-ownership rules and refrain from disturbing the peace and quiet of the neighbourhood. Prohibition on organising parties. A crowd and decibel controller (Minut) is connected in real time to the Saint-Marc loft: a sound volume of more than 75 db for more than 10 minutes will result in a €100 deposit being withheld. In the event of repeated problems, the entire deposit can be retained.

The client undertakes not to invite anyone other than the maximum of four guests, as Loft Saint-Marc reserves the right to intervene if necessary with the Police.
In any event, the customer undertakes to use the suite and its facilities with due care. Any behaviour or remarks contrary to good morals or public order will lead Loft Saint-Marc to ask the client to leave the flat immediately, without any reimbursement or compensation.

It is strictly forbidden to engage in any professional activity or any activity that is contrary to the laws and regulations in force in France or to accepted standards of behaviour.

Consultation of websites prohibited in France and illegal downloading are prohibited. The customer retains full and entire responsibility for his or her actions in this regard. The customer must make reasonable use of the Internet network provided.

Loft Saint-Marc will systematically check all the furniture in the flat and the accessories made available to the customer on leaving the premises. If it appears that the client has damaged any of these items, the cost of repairing or replacing the item will be invoiced to the client. A photograph of the item will be provided as proof of the damage. The customer acknowledges that he/she must pay the cost of restoring the goods to their original condition as soon as the complaint is received. The sums will be due on receipt of the letter of complaint, which will automatically accrue interest at the legal rate, in addition to conventional interest of 3% of the sum due.

In any event, Loft Saint-Marc will not be held responsible for the actions of the client or any of the client’s occupants in the course of providing services in the flat owned by Loft Saint-Marc.

Loft Saint-Marc may access, retain and disclose client information if it has a legal obligation to do so or if it believes in good faith that it is reasonably necessary to do so in order to respond to claims or comply with any legal proceedings, or for fraud prevention purposes.

Loft Saint-Marc has the right to investigate and take legal action in respect of any breach of the conditions of occupation, to the extent permitted by law.

In addition, Loft Saint-Marc reserves the right to remove or prevent access to all or part of its site in the event of a breach of these terms and conditions.

The customer acknowledges that Loft Saint-Marc has no obligation to monitor the customer’s access to or use of the site and the services, nor to examine, delete or prevent access to the site, but that it has the right to do so as part of the operation and improvement of the site and the services, to ensure that the customer complies with the conditions, to comply with the applicable law or the decision of a court, administration or government agency, to respond to content that it considers prejudicial or as described in these conditions. In addition, penalties may be charged to the customer and deducted from the deposit, at Loft Saint-Marc’s discretion.

10 – FORCE MAJEURE

Loft Saint-Marc cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, the actions of a third party or the actions of the customer.
In the event of force majeure or unforeseeable circumstances (such as compulsory work or work related to exceptional circumstances), Loft Saint-Marc reserves the right to cancel the order placed by the customer and undertakes to reimburse the customer in full, at no extra cost, within 14 days of the cancellation notice being sent to the customer.

11 – INSURANCE AND LIABILITY

Loft Saint-Marc may not be held liable in the event of non-compliance with legislation, theft, damage or loss of personal belongings of the client or any occupant of the apartment during the period of the contract binding the parties.

The flat is insured as a furnished rental property.

The Customer is personally responsible for his/her own personal civil liability cover, which he/she is presumed to have (including a holiday clause) on the day the order is placed.

The Customer acknowledges that he/she is responsible for the use of any products or equipment made available to him/her.

12 – STATE OF HEALTH

Persons suffering from heart problems, high blood pressure or who are pregnant are not permitted to use the spa.
In general, Loft Saint-Marc cannot be held responsible for the client’s state of health, and no refund or claim for compensation can be made as a result.

13 – EXTERNAL SERVICE PROVIDERS

If the payment has been made on a site other than that of Loft Saint-Marc, the terms and conditions of reservation and payment applicable are those of the said site.

14 – CHANGES MADE BY THE CUSTOMER

For any modification involving the cancellation of one of the services booked, the amount of the initial order remains payable.

15 – CANCELLATION BY THE CUSTOMER

Customers are reminded that they do not have the right of withdrawal provided for in article L. 121-20 of the French Consumer Code.
Payment is total and definitive as soon as the reservation is made.

16 – RESPECT FOR PRIVACY

The information requested from the customer is necessary to process the reservation. If this information is not provided, Loft Saint-Marc will not be able to process the reservation.
The customer may write to Loft Saint-Marc, whose contact details are indicated on the “Contact” page, to exercise his/her rights of access, opposition on legitimate grounds or without grounds in the case of canvassing, and rectification with regard to information concerning him/her that is processed by Loft Saint-Marc, under the conditions laid down in the law of 6 January 1978.
The information that the customer communicates to Loft Saint-Marc when placing an order is not transmitted to any third party. This information is considered confidential by Loft Saint-Marc. It is used solely by Loft Saint-Marc’s internal services to process the customer’s order and to strengthen and personalise communication and the range of services reserved for Loft Saint-Marc’s customers.
The customer has the right to expressly consent to receiving direct marketing by e-mail or post. The customer has the right to object, by e-mail or by registered post with acknowledgement of receipt, to their data being used for canvassing purposes, in particular commercial canvassing.

17 – INTELLECTUAL PROPERTY

All texts, images and sounds reproduced on the Loft Saint-Marc website are reserved as intellectual property for the entire world.
These General Terms and Conditions of Sale do not imply any transfer of intellectual property rights of any kind to Loft Saint-Marc or its assignees, such as photographs, images, literary texts, artistic works, brands, graphic charters, logos, etc., for the benefit of the customer.
Internet users who have a personal Internet site and wish to place, for personal purposes, on their site a simple link referring directly to the Loft Saint-Marc home page must obtain the prior and express authorisation of Loft Saint-Marc to establish this link.
In any event, hypertext links to the Loft Saint-Marc website must be removed at the first request of Loft Saint-Marc.

18 – APPLICABLE LAW

The applicable law is French law.
In the event of a dispute, and in the absence of an amicable agreement between the parties, the court having jurisdiction shall be the one with territorial competence.

19 – GIFT CARDS

All gift cards must be ordered and paid for in full on the Loft Saint-Marc website.
Nominative and non-refundable, gift cards are valid for 1 year from the date of issue.
It is active 3 days after the date of purchase to combat any attempts at bank fraud.
The recipient will be given a unique code enabling them to use their gift card.
The recipient of the gift card must confirm their reservation by paying the €2,000 deposit.

20 – DEPOSIT (2000€)

In the event of non-compliance with the rules and of damage, a deduction will be made from the security deposit. An administration fee (3%) will be added to the amount of the deposit withheld.

The organisation of a prohibited party will result in the eviction of all occupants by the police and a full deduction from the security deposit.

Any damage caused will result in the amount of the damage being deducted from the security deposit.

Any smell of cigarettes will result in a deduction of 200€ from the deposit.

Any object that disappears (theft) will result in a deduction from the deposit of the value of the object.

Clients must notify the concierge of any items they deem necessary on entering the premises. Without notification, clients accept the accommodation in good condition, fully functional and equipped.

21 – VIDEO MONITORING

For security reasons, the entrance (and only the entrance to the property) is monitored by an interior camera. This enables us to monitor the number of people entering the accommodation in real time (Read our security policy). Once again, we would like to point out that no parties are allowed on the premises. In the event of a serious incident, these images may be forwarded to the police.
